BidWorkers

These Terms of Service (“Terms”) govern your access to and use of the BidWorkers website, platform, applications, and related services (collectively, the “Platform”), operated by BidWorkers (“BidWorkers,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Platform Overview

BidWorkers operates an online marketplace that facilitates connections between individuals seeking home services (“Homeowners”) and independent service providers (“Professionals”).

BidWorkers does not:

  • Employ Professionals
  • Set pricing, schedules, or service terms
  • Supervise, manage, or control services
  • Act as a contractor, broker, or agent

All services are performed independently by Professionals.

2. Eligibility

You must be at least eighteen (18) years old and legally capable of entering binding contracts to use the Platform.

3. Account Registration

To access certain features, users may be required to create an account.

You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your login credentials
  • Accept responsibility for all activity under your account

BidWorkers reserves the right to suspend or terminate accounts that contain false or misleading information.

4. Platform Operation

For Homeowners

  • Homeowners submit service requests through the Platform
  • Requests may be viewed by Professionals in anonymized form
  • Communication and agreements occur directly with Professionals

For Professionals

  • Viewing job listings is free
  • Unlocking a job requires payment
  • Unlocking a job provides access to homeowner contact information
  • Pricing, scheduling, and service terms are agreed upon directly with the homeowner

BidWorkers does not guarantee job availability, selection, or completion.

5. Payments

All payments are processed by third-party payment processors. BidWorkers does not store payment card information.

Unlock fees grant access to contact information only and do not guarantee work, selection, or payment.

6. Independent Contractor Relationship

Professionals are independent contractors and are not employees, agents, partners, or joint venturers of BidWorkers.

7. User Conduct

Users agree not to:

  • Misrepresent identity or qualifications
  • Circumvent Platform payment mechanisms
  • Harvest or misuse personal data
  • Engage in fraud, harassment, or unlawful conduct

Violations may result in suspension or termination.

8. Intellectual Property

All Platform content, trademarks, software, and branding are owned by BidWorkers or its licensors and may not be copied, modified, or distributed without prior written consent.

9. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. BidWorkers disclaims all warranties, express or implied, to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, BidWorkers shall not be liable for indirect, incidental, consequential, or punitive damages.

BidWorkers’ total liability shall not exceed the amount paid to BidWorkers by the user in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BidWorkers from claims, damages, and expenses arising from your use of the Platform or violation of these Terms.

12. Termination

BidWorkers may suspend or terminate access to the Platform at its discretion to protect Platform integrity.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
