These Terms of Service (“Terms”) govern your access to and use of the BidWorkers website, platform, applications, and related services (collectively, the “Platform”), operated by BidWorkers (“BidWorkers,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Platform Overview

BidWorkers operates an online platform that connects individuals seeking home services (“Homeowners”) with independent service providers (“Professionals”).

BidWorkers provides a directory and matching system that allows:

  • Homeowners to browse and select Professionals
  • Professionals to create profiles and receive direct inquiries

BidWorkers does not:

  • Employ Professionals
  • Set or control pricing, schedules, or service terms
  • Supervise or manage services
  • Act as a contractor, broker, or agent

All services are performed independently by Professionals.

2. Eligibility

You must be at least eighteen (18) years old and legally capable of entering into binding agreements to use the Platform.

3. Account Registration

Certain features of the Platform may require account creation.

You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account

BidWorkers reserves the right to suspend or terminate accounts that contain false, misleading, or incomplete information.

4. How the Platform Works

For Homeowners

  • Homeowners may browse and view Professional profiles
  • Homeowners may select and contact Professionals directly
  • All communication and agreements occur directly between the Homeowner and Professional

For Professionals

  • Professionals may create profiles and list their services
  • Professionals may receive inquiries or leads from Homeowners
  • Professionals may be required to pay subscription fees and/or lead fees depending on their plan

BidWorkers does not guarantee:

  • The number of leads or inquiries
  • That a Homeowner will respond
  • That a job will be secured or completed

5. Payments and Fees

  • Payments (including subscriptions and lead-related fees) are processed by third-party payment providers
  • BidWorkers does not store payment card information

Fees paid to BidWorkers may include:

  • Subscription fees for platform access and visibility
  • Lead or connection-related fees (where applicable)

All fees are for access to the Platform and its features only and do not guarantee:

  • Job selection
  • Job completion
  • Payment from Homeowners

All pricing, payment terms, and service agreements between Homeowners and Professionals are handled directly between those parties.

6. Independent Contractor Relationship

Professionals are independent contractors and are not:

  • Employees
  • Agents
  • Partners
  • Joint venturers of BidWorkers

Professionals are solely responsible for:

  • Their services
  • Pricing
  • Licensing (if required)
  • Insurance (if applicable)
  • Compliance with laws and regulations

7. User Conduct

You agree not to:

  • Misrepresent your identity, qualifications, or services
  • Circumvent Platform systems or payment structures
  • Harvest, misuse, or distribute personal information
  • Engage in fraud, harassment, or unlawful conduct

BidWorkers may suspend or terminate accounts for violations at its discretion.

8. Intellectual Property

All Platform content, including but not limited to:

  • Branding
  • Logos
  • Text
  • Software
  • Design

is owned by BidWorkers or its licensors and may not be copied, modified, distributed, or used without prior written consent.

9. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, BidWorkers disclaims all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

10. Limitation of Liability

To the maximum extent permitted by law, BidWorkers shall not be liable for:

  • Indirect
  • Incidental
  • Consequential
  • Special
  • Punitive damages

BidWorkers’ total liability shall not exceed the total amount paid by the user to BidWorkers in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BidWorkers from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Platform
  • Your services or interactions with other users
  • Your violation of these Terms

12. Termination

BidWorkers may suspend or terminate access to the Platform at any time, with or without notice, to:

  • Protect Platform integrity
  • Prevent misuse
  • Enforce these Terms

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.
